FSF -> Xchat is violating the GPL

So, I've got a reply, Any work derived from a GPL's code is GPL'd, So My patch to xchat is GPL'd. And Peter is violating the GPL, Now shall I contact him and request the removal of my patch ? Or Shall this be raised ? That's what I don't know yet.
